Affiliate Terms of Service

1. Compliance with Laws & Regulations

• Affiliates must comply with all applicable laws and guidelines, including but not limited to:

  • The Federal Trade Commission Act (FTC Act)

  • The FTC Endorsement Guidelines

  • The CAN-SPAM Act

  • Any consumer protection, privacy, or advertising laws in their jurisdiction

• All marketing must include proper disclosures of affiliate compensation when required by law.

2. Permitted Promotion

• Affiliates may only use official creative assets (banners, videos, email templates, social images) provided in the affiliate resources section.

• Affiliates may adapt these materials for formatting or length, provided edits do not mislead or alter the meaning of the message.

• Any use of the American Eagle Pendant brand name, trademarks, or imagery outside official creative requires prior written approval.

3. Prohibited Advertising Methods

Affiliates are strictly prohibited from:

• Using deceptive, false, unsubstantiated, or misleading claims.

• Running ads or creating content that implies endorsement by government officials, political figures, or public offices without written approval.

• Bidding on or misusing trademarked terms (e.g., “American Eagle Pendant”) in paid search campaigns without permission.

• Using fabricated testimonials, fake endorsements, or unauthorized before/after imagery.

• Promoting the product on websites, apps, or social media pages that:

  • Engage in hate speech or violence

  • Encourage illegal activity

  • Misrepresent themselves as the official American Eagle Pendant brand page

• Sending unsolicited bulk emails (spam). All email promotions must comply with CAN-SPAM rules.

• Republishing full sales pages or videos in a way that obscures the original source.

4. Fraud & Abuse Prevention

• Affiliates may not manipulate tracking systems, cookies, or attempt to hijack traffic.

• Fraudulent practices such as click fraud, self-referrals, or creating fake transactions will lead to immediate termination.

• Affiliates who attempt to disguise fraudulent actions as legitimate marketing will forfeit all unpaid commissions.

• Affiliates must not incentivize purchases with cash rebates, unapproved gift cards, or unrelated bonuses that mislead customers.

• Monitoring systems are in place, and any suspicious activity will be investigated.

5. Tracking & Orders

• All orders must go through proper ClickBank HopLinks or approved tracking links.

• Affiliates may not bypass or tamper with the tracking system.

• If orders are found to originate from unapproved links or fraudulent activity, commissions will be voided.

6. Payments & Commissions

• Commission rates, thresholds, and payment methods are defined in your affiliate dashboard.

• Commissions are paid only on valid, qualifying orders.

• Orders that result in chargebacks, cancellations, or fraud will not generate commission.

• We reserve the right to adjust commissions or withhold payments if irregularities are detected.

7. Intellectual Property

• All trademarks, product images, videos, and other brand materials remain the property of American Eagle Pendant.

• Affiliates receive a limited, non-transferable license to use approved assets for promotional purposes only.

• Unauthorized use of brand assets will result in removal from the program.

8. Termination

• Any violation of these terms may result in immediate removal from the affiliate program.

• We reserve the right to terminate affiliates at any time, with or without cause, in order to protect our brand and customers.

• Affiliates terminated for fraud, abuse, or violation of rules will forfeit unpaid commissions.

9. Modifications

• American Eagle Pendant may update or modify this agreement at any time.

• Affiliates will be notified of material changes through their affiliate dashboard or contact email.
